I am wanting to seek legal action against the manufacturer. My insurance only gave blue book value to the car as it was unrepairable and had to be totalled. Thankfully, as I am short and if it had, then I would have been decapitated or killed from it. I also sustained bruising and back injuries along with the concussion. Luckily, the visor was down and protected my face.

I cracked my head into the windshield breaking my nose. I thought turning off the engine would stop the car since the brakes has failed but even turning off the engine, it raced even faster and the next thing I knew I had crashed into a tree totalling out the car. I steered the car trying to locate the emergency brakes but they were too far away for me to reach and still maintain the racing car. Without touching the gas pedal with my foot, the gas pedal dropped to the floorboard and the car raced forward with the gear shift still in “park”. I put the car back in park and restarted the car. However, when I started it the second time and was backing up a slight slope of a driveway, the car died. On the first start with the new battery the car behaved normally. On 7/20/03 the battery was getting weak so I bought a new battery compatible with the car.

That plus the fact that I had seen several white Luminas exhibiting the same paint peel. I’ve had it! Until I read about GM’s admission just recently that there was a defect in the paint process I thought the issue was exclusive to my car. Now, the right rear quarter panel, both right doors and right front quarter panel are peeling. As we speak the hood, left door, deck lid, left rear quarter panel, and roof have been repainted. This second time(roof) I was not even offerred a reimbersement of any kind. By this time I was furious, but rather than get into an arguement I once again had the work done ($400.00) and went on my way. I returned to the dealership and had the roof stripped and repainted.

The problem surfaced again in December of ’04 when the roof paint nearly completely peeled off. I had the work done(I have all receipts) and payed the bill. At the time I had no idea that this was a problem with any other GM vehicles other than mine. After determining what other areas of the car might be in jeopardy with regards to future paint peeling he(service manager and body shop foreman)concluded that to repair the car it would be $750.00 job and I would be responsible for $300.00 of the cost. He agreed that the car was obviously maintained well and that he would split the cost of the paint job. I suggested that if he would rather I drive the car around with his dealer nameplate attached and in it’s cosmetically deficient condition I would. It was clear to me that this was an obvious paint defect as the paint was peeling from the horizontal surfaces leaving a bright shiny grey primer beneath. He walked slowly around my car, noticed it’s condition was otherwise immaculate, brought me into his office and asked me, “what makes you think GM is going to paint your car”? I was shocked.

The service manager alleged he had never seen this problem. The first instance March / 01 I went to the dealership.
